Ambulance-chaser gets sued by clients who didn't get rich

It was bound to happen eventually.

Three Metro Detroit men--Ronald C. Moon of Livonia, Jeffrey D. Schmitz of Royal Oak and Louis J. Toth of Northville headed to New Orleans in the wake of Hurricane Katrina in 2005, allegedly bringing relief supplies to help devastated residents,

Somehow, when they got to Lake Charles, Louisiana, they did something that brought them to the attention of law enforcement and they were arrested outside a casino by Calcasieu Parish sheriff's deputies. They were locked up and held for five days before posting bond, during which time they complain that they were "verbally abused" and life wasn't fun or pleasant.

They returned to Michigan and immediately sought out an ambulance-chasing lawyer in an attempt to get paid, apparently selecting Birmingham attorney Norman Yatooma due to the publicity surrounding his other high-profile money-grubbing lawsuits. (I guess Geoffrey Fieger wasn't available?) They claim that Yatooma hired a couple of public-relations firms to spin their story and get them media attention, but then did little else and they "only" got a settlement offer of $25,000 in addition to having the charges against them dropped. So now they are suing Yatooma.

Their complaint? They feel that if Yatooma had made more noise and filed more papers against more people, they might have gotten even more money, despite the fact that they can't seem to show how they are entitled to any payout whatsoever.

That's right...required for a tort claim is a showing of some actual harm. In othert words, these tools would have to show how they somehow lost they money that they're seeking, or the opportunity to make the money. The point behind a tort claim is to put plaintiffs in the same place where they would have been had the tort not occurred. I'm thinking that in this case, had these guys not been arrested--and had they really been bringing relief supplies (and not looting as the police said that they were), they'd likely have returned home with empty vehicles and nothing but more stories about the things that they saw. Frankly, I don't see how that's worth $2.50, much less $25,000. You're not supposed to get a bucket of cash just because something unpleasant but otherwise not harmful happens to you, and especially not when you are part of the cause of your own misfortune by inserting yourself into an already chaotic situation like these gomers did.

Now I'm torn here. I think that these three jerks definitely have nothing coming, and if they were now suing anyone other than their own parasitical slip-and-fall guy, I'd be even more outraged. You see, I don't want to see these guys make a dime, but I also want to see shysters like Yatooma take a hit in the pocketbook for their role in abusing our nation's legal system to the point where it costs us all more money in higher insurance rates, more regulation and restrictions, and massive delays when we try to bring legitimate cases into court. True Karmic justice would be where these three meet with Yatooma to agree on a final payout only to have a meteorite land on all four of them or a sinkhole to open up beneath their feet.

Yeah, in this case I'm rooting against both sides, because a defeat for all of these people would be a victory for America and real justice.

They call it "dope" for a reason... yet another example.

So police in Mansfield, Lousiana executed a raid on a dope house, only to find the suspect who owned the house coming out of the bath room, no doubt grinning like the Cheshire Cat. The toilet was still running and it didn't take a rocket scientist to figure out that the dope had been flushed.

But all was not lost. The dope house wasn't connected to the municipal sewer system; it has a septic tank, meaning that the drugs hadn't gone far.

So the police brought a backhoe in and tore up the septic tank. A bag filled with meth, used needles and urned tin foil was quickly recovered, resulting in the arrest of the home's owner, Paul Fuller. Fuller, 49, of Frierson, was booked into the DeSoto Detention Center on one count each of possession of methamphetamine, possession of drug paraphernalia and possession of a firearm with a Controlled Dangerous Substance.

But the good guys scored even better. A second doper, Joshua D. Verhoef, 27, of White Oak, Texas, just happened to be present when the raid went down. He was taken into custody and charged with possession of methamphetamine, possession of drug paraphernalia and parole violation.

And if that wasn't fortuitous enough, a third knucklehead, Curtis Raye Tisdale, 58, of Greenwood, drove up to the scene as deputies were there. He consented to a search of his vehicle and wound up getting arrested along with his pals after drugs and a weapon were found in his vehicle.

Hint to dopers: Flushing dope doesn't work if you're on a septic system. Hint to dopers #2: if you're on parole, hanging around a dope house probably isn't a good idea, and hint to dopers #3: If you go over to your buddy's dope house and see the police all over the place, you might want to just keep driving, especially if you have dope and guns in your vehicle.

Yeah, folks, these guys perfectly represent the sort of brain trust that keeps telling us that drugs should be legal.

Grocery store cameras caught the woman taking a 24-can case of beer from a cooler, stashing the 20-pound case between her thighs by pulling up her housedress, pulling her dress back down, and waddling out of the store. But it took a while to identify and find her.

Lisa Newsome, 42, of Baker, didn't deny anything when she was arrested Monday, said Capt. David McDavid of the Zachary Police Department.

"She wanted to demonstrate it ..." he said. "I told her, no thanks, I wasn't into that."

She was booked into the East Baton Rouge Parish Prison on a theft charge, he said.

"We weighed a case," he said. "It was 20 pounds."

The theft was Aug. 22. McDavid said police learned the woman's identity last week and located her Monday afternoon.

Casey Rayborn Hicks, spokeswoman for the East Baton Rouge Parish Prison, said she did not know whether Newsome had an attorney. Newsome remained in jail Tuesday in lieu of $1,000 bail.

According to another report,

McDavid said Newsome has been arrested 40 times and has several convictions. Her arrests include felony theft, possession of cocaine, and writing worthless checks. According to Newsome's wrap sheet, she's even operated under several different aliases.

Oh, those fun-loving, politically-correct Democrats

Someone tell me again about how we get the government that we deserve.
And if that's true, it helps explain why Louisiana of all areas hit with a crisis alone descended into anarchy and chaos. Why? Because they keep electing mayors like Ray Nagin, congressmen like William Jefferson, and State representatives like Carla Dartez, who is now in the news for saying something that--if a Republican had said it--would have resulted in riots and demands for impeachment by now.

But since Dartez is a Dem, this isn't getting much play outside of the local area. Therefore, please allow me to let you all know what you're missing courtesy of the liberal, pro-Democrat media which is all but blacking this story out.

A couple of days ago, Dartez was talking on the phone with the mother of the local NAACP president, talking about their plans to bus voters to the polls on election day. (And I'm sure that they're not using the rides to push Democratic Party candidates because that would be wrong.) Dartez ended her call with long-time civil-rights activist Hazel Boykin by saying “talk to you later, Buckwheat.”

Whoa. Buckwheat? Damn, in the lexicon of insulting caricatures of black people, that one ranks right up there with Aunt Jemima and Amos and Andy. I mean, you just can't get any more demeaning and insensitive than that short of using the dreaded "N word".

And both hazel Boykin and her son Jerome are understandably pissed. They've withdrawn their support for Dartez and called on her to resign.
And Dartez told Jerome Boykin thhat if he mentioned the insult on his radio show, she would resign. Of course this was meant as a threat, as in "if you out me, I'll make sure that you get stuck with my challenger, and he's a REPUBLICAN!"

of course that didn't silence Boykin and he did talk about it. And like a typical Democrat, Dartez went back on her word once her bluff was called and now refuses to resign.

But what's telling is that Dartez had been an embarrassment to her party and the state before. Prior to qualifying for this election in September, she hit a pedestrian with her vehicle then failed a field sobriety test. However Dartez did apparently pass a breathalyzer test given later, although her blood-alcohol content has not been disclosed.

Additionally, earlier this month, her husband, Lenny J. Dartez, a member of the Democratic Party’s State Central Committee, was indicted for allegedly harboring illegal aliens through his construction business. Just what we need, eh? Thousands of jobs rebuilding Louisiana but none for Louisianans because the Dartezes make more money using illegals. She also racked up a DWI in 1998.

And this does nothing if it doesn't highlight the Democrats' double-standard. When Republican Senator Trent Lott said something nice about Strom Thurmond at Thurmond's 100th birthday party, Dems were in an uproar, demanding (and ultimately getting) his ouster from office. Yet Democrat Robert Byrd, a former leader in the Ku Klux Klan, still serves as a Senator with the blessing and support of the same people who called for Lott's head. I'm betting that those partisans are quick to overlook Dartez' insult to blacks as well because in the end, it's more important to get a majority than it is to remove racists from the Democratic party.

And if Louisiana voters re-elect Dartez, then we'll know that they really want and deserve a corrupt racist with a drinking problem as their advocate.

One strike and you're out for Michigan punk who went south

Poor Tony Massie, formerly of Plymouth, Michigan. He just couldn't make life work in Michigan and kept getting arrested for things like rape, breaking and entering, stealing cars and running from the police. So Tony did what so many other Americans have done over the years and he moved to a new place, ostensibly seeking that
"fresh start" and a new beginning.

Or maybe he just figured he could do better in a place where the police didn't already know him on sight.

Whatever his motivation for going to Louisiana, it probably wasn't such a good idea to go to a place where criminals who actually do get convicted of a crime draw harsh sentences. Tony just saved the taxpayers of Michigan from ever having to try and incarcerate him again by getting snagged for attempted robbery in the Pelican State. The judge took his prior record into account and gave the ne'er-do-well LIFE! And in the South, Life means "life"...Tony will someday leave Angola Prison but only feet first on a gurney.

Kudos for Southern justice. And Tony...if you can read this...you might want to have someone send you a whole lot of soap-on-a-rope!

Want to see the definition of arrogance and corruption?

I read this one half an hour ago for the first time, and I'm still furious at the arrogance exhibited by this public servant and her apparently still-unchanged belief that she is a special person to whom the laws and public safety do not matter.

The public servant in question is New Orleans City Councilwoman Cynthia Hedge-Morrell, who was stopped by the State Police back on February 26th for driving her city-owned SUV down Interstate 10 in excess of 100 mile per hour with a flashing blue light on the dashboard. Now aside from the fact that she was presenting a clear danger to every other citizen on that road, when she was stopped, rather than apologize to the Trooper, she reportedly launched into a profanity-laced tirade that began with "Do you know who I am?!" and included statements to the effect that she has authority to do what she wants. She allegedly screamed and swore at the Trooper, refused to exit her vehicle when instructed to do so, and told the Trooper that she would not wait for him to summon a supervisor, stating that she was going to leave and that he couldn't do anything about it.

A Louisiana State Police supervisor eventually did show up, and Hedge-Morrell wound up driving away without a ticket.

Now do you think that if you or I were stopped for driving over 100 mph on the I-10, we'd be going anywhere other than straight to jail in the back seat of the Trooper's cruiser?

But that's not even the best part. When the New Orleans Times Picayune interviewed Hedge-Morrell well after the incident, she expressed anger that the officer even stopped her and issued her a warning.

On Wednesday, Morrell said she still believes troopers should not have detained her.
"I was trying to get to the meeting, and he couldn't explain to me why he was detaining me any further," she said. "To this day, I don't know why he gave me the warning. I was late for a meeting."

So that excuses her grossly negligent behavior--behavior which could injure or kill other people and cost New Orleans millions of dollars as the result of lawsuits filed in the wake of her hitting someone.

Hedge-Morrell, a City Council member since 2005, said Wednesday that she rarely uses the flashing lights while traveling on the highway shoulder.

WTF? Who else gets to drive on the shoulder OR use blue lights, which are restricted to law enforcement officers under Louisiana state law. Again, you and I would be on our way to jail the first time we got caught doing this.

But this wasn't Hedge-Morrell's first time, either.

After the February traffic stop, another trooper wrote a memo regarding a similar stop on Jan. 19.

Troopers stopped Hedge-Morrell in late February after an angry highway driver followed the councilwoman's vehicle for miles, using his cell phone to call authorities and detail the erratic roadway maneuvers.

Gary Russo, a construction worker from LaPlace who commutes each day to Jefferson Parish, said in an interview that it was the fourth time in four months he has seen what appeared to be the same vehicle speeding, with sirens on. He said he grew enraged after watching the vehicle with tinted windows and flashing lights weave past.

"We all have to deal with traffic, simple as that," he said. "She ain't the president."

So Russo called the State Police.

"What would happen if someone zigged and she zagged?" Russo said. "She could have killed someone."

Hedge-Morrell told him she was late for a meeting, according to records. The trooper made a note of the stop on a business card and brought the incident to his supervisor after hearing of the second incident.

Oh, and as to the lights and their restriction to law enforcement only?

Hedge-Morrell said she was commissioned by the Orleans Parish Civil Sheriff's Office and owns a badge.

"The lights are there for a reason," she said. "I'll leave it to my driver to decide when it should be used."

So what's going to happen now? You know it--not a damned thing. She's a Democrat in New Orleans, elected by the same fools and simpletons who re-elected Ray Nagin after he botched the Katrina affair so badly. It's obvious that the State Police are willing to cave to a city official and set a double standard--one set of rules and consequences for us and another set of (unenforced) rules with no consequences for her and presumably other public servants.
